Malta Update
UPDATE NUMBER 04/2024/01
In light of the emerging Regulation (EU) 2022/2554 on Digital Operational Resilience for the Financial Sector, entities under Capital Markets Supervision must classify their organization size as “Microenterprise”, “Small Enterprise”, “Medium-sized Enterprise”, or “Non-SME”.
Guidelines provided by the European Commission, namely the User Guide to the SME Definition and the SME Self-Assessment Questionnaire should be followed for this purpose.
Such entities are required to:
- classify their organisation size in their Corporate Profile on the Licence Holder Portal, by selecting the correct classification within the SME field; and
- fill and upload a self-declaration form, available here, beneath the SME field.
The classification selected within the SME field and the classification submitted within the self-declaration form must match.
The Corporate Profile within the Licence Holder Portal had to be updated by no later than 30 April 2024.
